These are the ground rules for sxMail. I wrote them the way I would explain them to you in person, without making them any less binding. Whoever reads them knows what to expect from me and what I expect from them.

1. Who with whom
These terms apply between you and me, Dennis Parsch (address in the imprint), for everything you use through sxMail.de: mailbox, calendar, contacts, files, the web app and the apps for desktop and Android. Terms of your own do not apply, even if I do not expressly object to them.
2. How an account comes about
A mailbox is available on request through the contact form or by email, fastest with a recommendation from an existing user. I decide freely whether to set up an account; there is no entitlement to one. The contract of use comes into being when I set it up and you sign in for the first time. You have to be at least 16 or have your parents' consent.
An account is for one person. Several accounts are fine if you let me know. Creating accounts for others or passing them on is not fine.
3. What you get
- a mailbox with 2048 MB of storage, more on request,
- calendar, contacts, notes and files, through the web app and, over IMAP, POP3, SMTP, CalDAV, CardDAV and WebDAV, with any other program too,
- the web app and the apps for desktop and Android,
- and all of it without third-party advertising and without analysis of your data (see privacy).
The private mailbox is free, and it stays that way. Business customers get individual plans, agreed separately. Donations are voluntary and create no entitlement to anything.
4. What I expect from you
- No spam. No advertising to people who do not want it, no bulk mail, no chain letters. Whoever sends spam through sxMail is out, because they damage the server's reputation for everyone else.
- Nothing illegal. No malware, no phishing, no content that violates the rights of others or is a criminal offence. You may store copyrighted files for yourself, but not distribute them through share links.
- No abuse. No attacks on sxMail or other systems, no circumventing of limits, no forged senders.
- Your password is yours. Keep it secret, use a strong one, and tell me immediately if you think someone has access. You are responsible for everything that happens with your account until you have reported it.
- Stay reachable. Store a recovery address so you can get back in after a forgotten password.
5. Referrals
Every user has a referral code. Whoever recommends someone vouches for them: if you repeatedly recommend accounts that break these rules, I can disable your code. A referral brings no advantage to you or the person referred; it only says that someone vouches for them.
6. Availability and backups
I run sxMail on my own hardware and do my best to keep it running around the clock. I cannot guarantee availability, though: maintenance, outages and, in the worst case, data loss are possible. So back up yourself what you cannot afford to lose; over IMAP and the DAV protocols that works with any program. I announce planned maintenance if it takes longer than a few minutes.
7. Inactive accounts
A mailbox that has not been used for a year (signing in through the app, IMAP or POP3 counts as use) may be deleted by me, with all its content. Before that I send a warning to the mailbox and to the recovery address, with at least 30 days' notice. A newly set-up mailbox that nobody signs in to within 30 days I delete without warning.
8. Termination
You can terminate at any time; an email to info@sxmail.de from the mailbox is enough. I can terminate with 30 days' notice, for example if I have to shut the service down. On a breach of section 4 I can suspend or terminate the account immediately; for minor breaches I get in touch first. After the end I delete the mailbox within 30 days, see privacy.
9. Liability
I am liable without limit for intent and gross negligence and for injury to life, body or health. For ordinary negligence I am liable only if I breach an obligation that makes the contract possible in the first place and on whose fulfilment you may rely; in that case liability is limited to the foreseeable damage typical of the contract. For data loss I am liable within that frame only insofar as the loss would not have occurred with a reasonable backup of your own (section 6). Further claims are excluded. Liability under the German Product Liability Act remains unaffected.
Conversely: if you breach section 4 and I suffer damage from it, for instance because the server ends up on block lists, I can claim compensation.
10. Changes
If I change these terms, I tell you at least four weeks in advance by email and explain what changes. If you do not object by the effective date, the new terms apply; I point that out in the email. If you object, the contract ends on the effective date. Changes that are only to your advantage or become legally necessary I can apply immediately.
11. Law and court
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory protective provisions of your country of residence remain unaffected. If you are a merchant or a legal entity, the place of jurisdiction is my place of residence. I am neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
12. If a rule does not hold
Should one of these rules be invalid, the others remain valid.
